It is extremely common for beneficiaries of an estate to come into conflict with an estate trustee regarding the administration of an estate.

Conflicts between beneficiaries and trustees or executors can occur in a variety of circumstances, such as (but not limited to):

• Failure of a trustee to distribute the estate assets according to the will (or at all),
• Executor compensation,
• Failure of an estate trustee to account to beneficiaries,
• Breach of an estate trustee’s fiduciary duty,
• An estate trustee using estate assets for their personal benefit and
• Family conflicts

When a beneficiary’s grievances become so serious as to call for an estate trustee’s removal and replacement, the matter may require judicial intervention and may need to be litigated.
